The post holder will play an important role within the safeguarding team to provide assurance that the Trust legal framework is applied effectively and consistently on all Trust sites. This will involve making an active contribution to support and maintain the legal administration of the Mental Health Act (MHA) 1983 and the Mental Capacity Act (MCA) 2005. The post holder will be expected to provide advice to all professional staff on the Trust legal framework of the MHA/MCA, including Deprivation of Liberty Safeguards (DoLS).
1. The post holder will contribute to the process of assurance for the Trust’s legal framework, monitoring and maintaining tracking systems for DoLS and MHA, escalating any potential breach to the MHA/ MCA Support Manager.
2. The post holder will identify need for remedial changes for all submitted legal documentation that imposes a restriction on the patients Article 5 human rights to leave an in-patient setting across the Trust. The post holder will escalate immediately to the MHA/MCA Support Manager or designate for further consideration of appropriate action to correct error and prevent unlawful detention of the patient.
1. The post holder will add/ amend data on to the MHA and DoLS tracking tools once trained by the MHA/ MCA Support Manager how to use the excel database for this purpose.
1. The post holder will plan, organise, and check IT connection systems are effective to ensure the smooth running of Mental Health Tribunals and MHA Managers Meetings.
1. The post holder will ensure that detailed data is inputted and maintained on the HIVE and Ulysses system.
1. The post holder will provide statistical information and reports/ audits on use of the trust legal framework as required by the MHA/ MCA Support Manager.

Job Summary:

The post holder will be expected to provide advice to all professional staff on the Trust legal framework of the MHA/MCA, including Deprivation of Liberty Safeguards (DoLS). The postholder will be required to work to agreed deadlines for submission of assigned work and show an ability to apply flexibility to meet other important requests for support from the MHA/ MCA officer. The postholder will demonstrate excellent organisational skills and general administrative tasks to a high standard, being comfortable with office applications, accessing excel databases, as well as other Trust systems. The post holder will also be expected to carry out general administration duties as required.
The post holder will be expected to work as part of the team in the delivery of an efficient and fully compliant MHA/MCA administration service. This will require the ability to develop and maintain good working relationships with staff throughout the Trust as well as partner organisations.
The Safeguarding team is a corporate Trust wide service and as such the post holder could be asked to work across the Trust footprint at dedicated safeguarding team office environments, although will be provided with a regular work base.
