The Bureau of Justice Assistance (BJA) is responsible for providing federal leadership and assistance in support of state and local criminal justice strategies to achieve safe communities, and its Public Safety Officers' Benefits (PSOB) program provides death and education benefits to survivors of fallen law enforcement officers, firefighters and other first responders, and disability benefits to officers catastrophically injured in the line of duty. The incumbent in this position provides legal advice to all BJA personnel as to all questions of law arising from the processing or adjudication of any claim under the PSOB Program, ensuring that such processing and adjudication is discharged in compliance with law, after due diligence and inquiry, and without fraud, waste, or abuse.

PSOB Act Analysis, Advice and Guidance

Addresses complex legal issues while providing counsel to the BJA Director and the PSOB Program. Prepares administrative decisions, reports, legal briefs, opinions, and other documents related to PSOB legal matters. Participates in the drafting of legislation and regulations. Provides legal guidance to support the program's policies and procedures.

Reviews proposed legislation and regulations to assess their impact on the PSOB program and drafts memoranda and guidance accordingly. Makes recommendations based on feedback from the PSOB Program and assesses the legal implications of the proposed legislation. Suggests alternative language, as appropriate.

Coordinates the work of the PSOB's Legal Counsel's Office, and establishes clear project goals, systems, and methodologies to enhance the legal review process, case tracking, communications with the PSOB Office, work assignments, and timely case processing. Develops policies and procedures to streamline legal reviews, reduce backlogs, and improve the timeliness of claim determinations.

Provides updates to national public safety organizations and survivor groups about laws and regulations. In keeping with OJP procedures, assists the BJA and PSOB Director in responding to congressional and media inquiries regarding the Program.

Provides information and guidance to the OJP Office of the Chief Financial Officer on PSOB Program legal matter-related submissions for the President's budget, including Office of Management and Budget data-call submissions and DOJ spend plans.

PSOB Claims Review

Reviews claims filed under the PSOB Act and provides well-reasoned and thorough legal advice.as to legal sufficiency of determinations. Provides advice, support, assistance, and direction to all BJA personnel in evaluating what evidence or information may be necessary, desirable, or relevant to such processing or adjudication, and in obtaining such evidence or information, including from state, local, and federal agencies, as well as private parties, and including, as appropriate, through the use of administrative subpoenas. Ensures that the language of claim determinations is legally sufficient in articulating legal and factual grounds of the decision.

Oversees and manages the process initial level legal review of claims, provides legal guidance to independent hearing officer reviews of claims, and drafts of final agency determinations of claims. Trains legal personnel assigned to the program. Performs legal research in connection with issues that arise in particular claims and advises on relevant federal laws and regulations, DOJ rules and policies, and other laws that may be implicated by claims.

Supervision

Provides administrative and technical supervision necessary for accomplishing the work of the PSOB Legal Counsel's Office. Assigns, reviews, and supervises work of legal staff, provides guidance and training, manages staff performance, recruits and recommends action regarding hiring, and addresses personnel issues. Develops work plans, sets performance goals, and ensures team objectives are met in alignment with organizational priorities. Formally evaluates employee performance and resolves informal complaints and grievances. Fosters a collaborative work environment, encourages professional development, and maintains high standards of productivity and quality.

Duties assigned to this position could include:

Provide legal analysis and advice on matters and problems that arise in the development of highly visible legislative and regulatory proposals, focused on energy conservation standards for residential appliances and commercial equipment.

Advise program offices on rulemaking requirements under the Administrative Procedure Act and compliance with applicable enabling statutes, Executive Orders, and other statutes governing the regulatory process.

Develop, draft, review, participate in negotiations, and provide comment on legal documents primarily concerned with DOE's responsibilities in this area.

Coordinate with the Office of the Assistant General Counsel for Litigation and the U.S. Department of Justice to defend against legal challenges to energy conservation standards issued by DOE.

Provide legal analysis and advice as program counsel for certain other programs within DOE. This analysis and advice will span several statutory authorities and will require coordinating legal advice among several offices within DOE's Office of the General Counsel.

Review and advise program offices on the development of regulations, directives, reports, guidance, correspondence, and other agency documents, and ensuring compliance with applicable enabling statutes, Executive Orders, and other requirements.

About the General Law Office

The Office of General Counsel (OGC) serves as the chief legal advisor to the Agency's senior management and program offices on Agency rules, permits, response actions, implementation actions, litigation and legislation. The General Law Office is one of several law offices that comprise OGC and consists of four practice group areas- information management law, information access law, employment and labor law and information technology and intellectual property law (IPIT). Incumbent provides national legal advice on issues involving patents, copyrights, trademarks, data rights, and other forms of intellectual property to the EPA Office of Research and Development, the EPA laboratories, and other EPA program offices. As the Patent Attorney in this position, you will:

• Serve as the legal authority on EPA's patents and ensure that legal position/rights of the Agency, inventors, and contractors are clearly defined and protected; this includes working with the US Patent and Trademark Office to ensure patents are properly maintained and prosecuted and consulting with scientists, laboratory directors, and contractors regarding potential patent awards.

As a Supervisory Attorney-Advisor (General), GS-0905-15, your typical work assignments may include:

• Providing legal advice to contracting officers, program managers, and senior officials concerning the laws applicable to all phases of the R&D contracting process, including acquisition planning, solicitation and award, contract administration, and the resolution of bid protests/disputes. The ideal candidate would have some experience with R&D centric solicitation and award instruments (e.g., Other Transaction Agreements, Small Business Innovation Research Program, Prize Competitions, and/or Partnership Intermediary Agreements).
• Providing legal advice for the full range of issues arising in the fields of R&D contracting and R&D grants/cooperative agreement awards, including intellectual property rights, technical data, claims, bid protests/disputes, fiscal law, information security, protection of governmental rights and property, and other related areas which arise in furtherance of and in connection with the mission of the Science and Technology Directorate (S&T).

This position is located in any of the divisions that come under the Directorate of Acquisitions and Bibliographic Access. It is a hybrid position that combines major duties from both the acquisitions specialist and the cataloger. As a Trial Attorney in the Office of the General Counsel (OGC), you will serve as the Litigation, Enforcement and Adjudication’s (Litigation) subject matter expert (SME) in labor and employment matters, including those that could pose a litigation risk to the agency. Responsibilities will include, but are not limited to:

• Representing the agency before the Merit Systems Protection Board (MSPB) and the Equal Employment Opportunity Commission (EEOC).
• Providing legal counsel to the agency on complex aspects of employment and labor law and represents the agency in employment and labor litigation matters.

The Head of Reference Services in the Hispanic Reading Room is responsible for the day-to-day operation of the Section, supervising the staff, and serving as a lead reference in matters dealing with the countries, languages, and regions within the Section's geographic areas of responsibility. Under the guidance of the Division Chief, the incumbent assures the provision of timely and accurate reference service to the Congress and other Library patrons, directs the development and maintenance of the Library's collections pertaining to the region, facilitates access to these collections for scholars, researchers, and others worldwide, and manages the development of digital technology to advance the Section's goals. 

The incumbent plans and produces educational programs, exhibits, seminars, and colloquia to bring attention to research developments and collections of interest to scholars and the general public.
