The Opportunity
Our client are seeking an experienced and highly skilled Senior Intellectual Property Legal Counsel to join our Legal and Compliance team in an in-house capacity. As a Senior Intellectual Property Legal Counsel, you will be responsible for providing comprehensive legal guidance and support related to intellectual property matters, including patents, trademarks, copyrights, trade secrets, and other related areas. Your expertise and strategic counsel will be crucial in protecting and maximizing the value of our Group’s intellectual property assets.
Key Responsibilities:
1. Intellectual Property Strategy: Implement effective intellectual property strategies aligned with the Group's business objectives. Provide strategic advice on intellectual property matters and identify opportunities for innovation and protection.
2. IP Registration and Maintenance: Manage the registration and maintenance of patents, trademarks, and copyrights, respond to official actions, and handle related administrative processes.
3. Trade Secret Protection: Implement the Group’s robust trade secret protection programs. Advise on best practices for safeguarding confidential information and proprietary technology.
4. Intellectual Property Enforcement: Proactively monitor and enforce intellectual property rights. Identify and address potential infringement issues, including drafting cease and desist letters, initiating legal actions, and collaborating with external counsel when necessary.
5. Intellectual Property Litigation: Manage intellectual property litigation matters, including patent, trademark, and copyright disputes. Collaborate with external counsel and provide strategic guidance throughout the litigation process.
6. Contract Review and Negotiation: Review and negotiate intellectual property-related agreements, including licensing agreements, technology transfer agreements, joint development agreements, and research and development agreements. Ensure compliance with intellectual property laws and regulations.
7. Intellectual Property Portfolio Management: Maintain an accurate and up-to-date intellectual property portfolio. Conduct regular audits and assessments to identify opportunities for portfolio optimization, including identifying and addressing any gaps or risks.
8. Internal Collaboration: Collaborate cross-functionally with various departments (including Technology & Innovation team); and provide intellectual property advice and support.
Qualifications:
• Experience: Solid knowledge and experience in intellectual property rights (patent, trademark, copyright, and trade secret) law and protection with over 5 years relevant experience at MNC.
• Legal Qualifications: Qualified lawyer of 10+ post-qualification experiences (admitted in Singapore and commonwealth jurisdictions).
• Technical Background: Bachelor's degree in Chemical Engineering or a related field is an advantage; or substantial experience in communicating with R&D engineers in chemical field with strong understanding of technical concepts and ability to analyze complex inventions and technologies.
• Intellectual Property Expertise: Extensive experience in intellectual property rights on non-contentious and contentious matters, including patent, trademark, and copyright disputes; demonstrated experience in patent, trademark, and copyright registrations and maintenance.
• Strong Communication skills, proactive personality with sound analytical and strategic thinking and ability.
• Strategic Thinking: Strong problem-solving and analytical skills, with the ability to identify and mitigate potential risks.
• Based in Singapore. Willing to travel for business.
• Familiarity with industry practices (chemical and energy sector) is an advantage.
