Compliance Department

A strong compliance culture is central to the firm’s values. The Compliance Department is comprised of two organizational functions.   The first is business unit compliance, which is generally co-located within the various business units and is the first point of contact for all compliance related issues and questions that arise in the business.  The business unit compliance team is responsible for providing advice and general compliance guidance as well as drafting line of business specific policies and procedures.  The second function is cross line business compliance.  This function provides cross line of business support including: compliance reviews; handling regulatory inquiries and exams; conflict and risk identification; monitoring and surveillance; ethical walls; personal trading; compliance policies and procedures; and continuing education and training.  

POSITION OVERVIEW

The Compliance team seeks a full-time Senior Associate. This position will be a member of the business unit compliance team.  The business unit compliance team provides advice and guidance, addresses business specific issues, and drafts business policies and procedures tailored to Bain Capital, including supporting Investor Relations and Bain Capital’s affiliated broker-dealer.  These business compliance officers serve as the first point of contact for compliance-related questions and issues that may arise. Specific responsibilities may include some or all of the following responsibilities:

• Address compliance and risk-related matters, questions and concerns raised by the business(es) she/he covers.
• Develop and implement all compliance requirements in the business(es).
• Develop applicable policies and procedures for business unit functions.    
• Partner with Investor Relations on the review of marketing materials and investor communications for compliance with applicable regulations and to ensure consistency and high standards of disclosures.
• Advise on certain aspects of Bain Capital’s fundraising process, including monitoring international marketing restrictions.
• Assist in investor onboarding process related to compliance with AML and KYC policies and procedures.
• Work with Compliance team to ensure relevant regulatory filings, including Form ADV, Form PF, Form BD, Form BR, and other filings, are submitted appropriately.
• Collaborate with the Compliance team to cover all business areas. 
• Respond to issues and questions identified by the surveillance staff.
• Assist with compliance assurance matters and examination readiness. 
• Communicate to management all issues and risks that need to be addressed.  
• Work on long term projects aimed at strengthening the compliance program.

General Qualifications

• Bachelor’s degree with a strong GPA.
• 4 to 6 years of relevant experience required.
• Working knowledge of regulatory compliance and Advisers Act regulation.
• Dedicated team player with a strong sense of ownership, self-assuredness, and follow-through skills.

KEY RESPONSIBILITIES:

Asset Management:

• Perform daily and long-term operational and strategic management of hardware and software
• Plan, monitor, and record hardware assets and/or software licenses to make sure they comply with vendor contracts
• Apply a continuous improvement approach in enhancing the strategies employed in technology spending, as well as in tracking company assets within the Configuration Management Database (CMDB) throughout their lifecycle
• Ensure effective management of the CMDB and that the content contained is accurate
• Manage a small team of asset analysts and supervise their performance
• Perform verification and audit of CMDB content; verify software assets with license contracts, confirm hardware assets with actual inventory, and initiate corrective actions and tract them
• Refine processes relating to software and hardware asset management, execute and enhance them
• Establish and maintain documentation of procedures, processes, and reports concerning asset and configuration management
• Take part in other ITSM processes, or as required perform as a back up to maintain operational activities
• Create and execute governance and strategic asset management function
• Collaborate with infrastructure teams to determine trends in asset performance
• Perform research on industry best practice and incorporate it with organizational practices

Asset Lease Program:

• Manage annual PC hardware refresh program globally to ensure that assets are returned to leasing company in a timely manner.
• Liaise with and maintain relationship with leasing vendor.
• Work closely with procurement and finance teams on lease orders.  Proficient with corporate mobile device accounts (AT&T and Verizon preferred). This includes adding new lines of service, placing upgrade orders, line transfers and meeting regularly with our carriers to review data usage.

QUALIFICATIONS:

• Five years or more in an IT Asset role.
• Strong knowledge and five years plus experience working with a CMDB and the specific business services that it supports
• Five years or more ITSM tool experience, as well as ServiceNow experience
• Proven ability and experience in executing strategic asset management processes successfully
• Strong knowledge of licensing agreements involving software, including Microsoft.
• Strong vendor management and negotiation skills
• Strong knowledge of IT Service Management processes, as well as experience with Discovery tool
• Possess Bachelor’s degree in information technology, computer science, or business administration, or in other related field
• Strong ability to carry out assigned tasks independently with little supervision
• Excellent at performing multiple tasks at the same time without erring
• Excellent communication and interpersonal skills
• Possess IAITAM Certification, such as CHAMP, CSAM, and CITAM.
