This position is located in any of the divisions that come under the Directorate of Acquisitions and Bibliographic Access. It is a hybrid position that combines major duties from both the acquisitions specialist and the cataloger. There is a foreign language requirement for this position depending on the geographical area for which cataloging or acquisitions functions are being performed. 

As a Trial Attorney in the Office of the General Counsel (OGC), you will serve as the Litigation, Enforcement and Adjudication’s (Litigation) subject matter expert (SME) in labor and employment matters, including those that could pose a litigation risk to the agency. Responsibilities will include, but are not limited to:

• Representing the agency before the Merit Systems Protection Board (MSPB) and the Equal Employment Opportunity Commission (EEOC).
• Providing legal counsel to the agency on complex aspects of employment and labor law and represents the agency in employment and labor litigation matters.
• Conducting research into the law, analyzes and reviews or prepares briefs and pleadings for important cases in the United States District Courts, MSPB, EEOC, FLRA and its FSIP in which the Commission is a party.
• Representing the Commission as a trial attorney in complex and sensitive court proceedings, trials, hearings, arbitrations, and mediations concerning all facets of federal labor and employment laws before Administrative Judges of the Equal Employment Opportunity Commission (EEOC), Merit Systems Protection Board (MSPB), Federal Labor Relations Authority (FLRA), and federal and district courts.
• Developing case strategy, tactics and presents arguments effectively from the initial complaint or charge through the conclusion of the administrative hearing, court and/or appeals processes.
• Analyzing litigation risk cases to determine the advisability of Commission participation as amicus curiae and, when appropriate, prepares necessary briefs and may argue cases.
• Consulting with management and the Division of Administration in matters arising under labor and employment law.
• Developing case strategy, briefing, and arguing cases in the federal district courts and courts of appeals in which the Commission is a party or amicus. Experience with litigation under the Administrative Procedure Act is preferred;
• Reviewing and providing legal analysis on proposed litigation under the CEA and Regulations;
• Researching and analyzing applicable statutes, regulations and case law involving complex and sometimes novel legal theories and advising the Commission of the same;
• Drafting memoranda and pleadings involving legal issues in CFTC cases in the federal courts and administrative forums.
• Analyzing outside litigation to determine impact on the CFTC and/or the advisability of the Commission’s participation as amicus curiae.
• Advising the Commission on appeals from its administrative adjudications program; includes reviewing the record and pertinent case law and recommending a course of action, drafting final orders and opinions at the direction of the Commission.
• Advising the Commission with regard to issues involving privilege, cost-benefit analyses, and subpoenas.
• Working with other divisions within the CFTC to ensure accuracy and coordinate substantive presentations during litigation.
• Responding to substantive and procedural novel and complex questions within the agency concerning the CEA and regulations promulgated thereunder and interpreting and analyzing laws and regulations, court rulings, precedents, and legislative changes that impact CFTC’s programs and operations.
• Filing proofs of claim and objecting to discharge in bankruptcy matters.
• Reviewing agency policies, regulations, and procedures to ensure they are legally and administratively sound and effective in operation.

• Serves as administrative law attorney advisor for the Joint Task Force – National Capital Region (JTF-NCR) and US Army Military District of Washington (MDW), Office of the Staff Judge Advocate.
• Prepares legal opinions on questions of law pertaining to the operation of the military installation.
• Issues regularly involve complex and difficult legal or factual questions because of the absence of clearly applicable precedents due to the newness of the program and require a high order of original and creative legal endeavor.
• Provides oral and written advice concerning General Administrative Law, Garrison Legal Advisor, Ethics, National Security Law, and Labor Law.

• Responsible for providing case management for a complex caseload of homeless Veterans in the HUD-VASH programs in rural and remote regions of Central Washington.
• Performs on-site visits of HUD-VASH apartments/housing units in rural and remotely separated communities to ensure that Veterans reside in safe environments in compliance with local housing codes.
• Coordinates care including serving as an advocate on behalf of the Veterans and their family members to ensure comprehensive service delivery and linking and referring Veterans and families to the VA Medical Center, VA Regional Offices and/or community agencies. Must have extensive knowledge of programs and services providers in communities throughout the Central Washington Region.
• Implements the Housing First model within the HUD-VASH program.

The Head of Reference Services in the Hispanic Reading Room is responsible for the day-to-day operation of the Section, supervising the staff, and serving as a lead reference in matters dealing with the countries, languages, and regions within the Section's geographic areas of responsibility. Under the guidance of the Division Chief, the incumbent assures the provision of timely and accurate reference service to the Congress and other Library patrons, directs the development and maintenance of the Library's collections pertaining to the region, facilitates access to these collections for scholars, researchers, and others worldwide, and manages the development of digital technology to advance the Section's goals. 

The incumbent plans and produces educational programs, exhibits, seminars, and colloquia to bring attention to research developments and collections of interest to scholars and the general public. The incumbent may be responsible for cultivating relations with potential donors, securing funds for new initiatives, acquiring new collections, and establishing new services. In addition, the incumbent may also be assigned to perform general administrative duties for the division and to serve in lieu of the chief as required. 

Supervises the work of the Section's staff. Plans the work of the Section, including formulating goals and objectives and identifying opportunities for improvements in methods and procedures. Supervises and participates in the preparation of reports, translations, bibliographies, exhibits, web pages and other information products of the Section.  Performs the administrative and human resource management functions relative to the staff supervised. Establishes guidelines and performance expectations for staff members, which are clearly communicated through the formal employee performance management system.

Plans, establishes, and directs a library reference program to provide information about the region. Oversees all reference service provided by the section's staff. On assignment, supervises staffing of the division's reading room and administers the policies and regulations concerning security and access to the collections.  Collaborates with other Library staff and outside partners in the U.S. and abroad in developing and providing access to library resources through the web and by other means.

Makes significant recommendations to change, interpret, or develop important or innovative policies affecting the process and funding of acquisitions from and relating to the area of the section's responsibility.  Oversees staff making authoritative recommendations for the acquisition of material in all languages, formats, and subjects of relevance to the study of the region, including legal, audiovisual, and electronic items.

Plans and produces public programs, exhibits, seminars, and colloquia on the region, bringing attention to research developments and collections of interest to both scholars and the general public. Under the guidance of the Division Chief, may be responsible for cultivating relations with potential donors and securing funds for acquisitions, public programs, exhibits, and other activities related to the section's geographic area.

Reviews and analyzes major issues in information research and dissemination as they apply to providing information about the region.
